Fiancé

Ever watch 90 Day Fiancé? The underlying basis for that show is the K-1 visa. An American citizen falls in love with a foreign national, proposes and an engagement ensues. The American citizen can then begin the process to sponsor the foreign national for a single-entry visa for the sole purpose of getting married in the United States within ninety days of entry.

The process starts with paperwork filed with USCIS, which must provided preliminary approval, before the process is shifted to a U.S. embassy or consulate for completion. Documentation will be required to establish how and when a relationship began, and in-person meeting, and that both parties are legally eligible to marry. The U.S. citizen will need to provide satisfactory proof of financial wherewithal to demonstrate the ability to support and the unlikely need for public assistance. Once approved, a K-1 visa is granted, the foreign national enters the U.S. and a marriage in the U.S. must take place within ninety days of entry. Once married, the foreign national must apply for permanent residency in order to secure status as a lawful permanent resident (Green Card Holder). Marriage, by itself, does not establish.

Young children of the foreign national can be incorporated into this process, but adult children cannot. Permanent Resident are not eligible to sponsor fiancés.
